Marriage Requirements

MARRIAGE LICENSES

The County Recorder's office is the only office in Idaho authorized to issue a marriage license. The recorder may issue marriage licenses to any persons applying for them, regardless of their home addresses, if the persons are entitled to marry under Idaho Code (32-401).

If you will be married in Idaho, you must obtain a marriage license in Idaho. If you will be married in another state, you will need to get a marriage license from that state. There is no waiting period or blood tests required in Idaho for marriages.

Marriage licenses may be applied for online in the Recorder's office between 8 a.m. and 4:30 p.m. Monday through Friday. Marriage licenses may also be applied for on the County's web site, however, all parties to the marriage must appear in person at the Recorder's office to complete the application process between 8 a.m. and 4:30 p.m.

Two copies of the license and marriage certificate are issued.  Both copies of the license are to be filled out by the minister or official solemnizing the marriage. One copy of the license is to be returned to the County Recorder within 30 days of the date of marriage for recordation (Idaho Code Title 32-402).

The other copy of the license is for the couple to keep for their records.

IDAHO REQUIREMENTS

Requirements for parties over 18 years of age:

  • Completion of the marriage application either in the Recorder's office or over County's web site
  • Both parties need to appear at the Recorder's office in person for application processing
  • Both parties need forms of photo identification (See below for acceptable documents)
  • Both parties must read and sign a Premarital HIV/AIDS Education Pamphlet as required by Idaho law
  • Cost: $28.00. Payments types accepted are cash or credit card

Requirements for Parties Ages 16 and 17:

  • Completion of the marriage application either in the Recorder's office or over County's web site
  • Both parties need to appear at the Recorder's office in person for application processing
  • Each applicant who is 16 or 17 years of age must have a parent/guardian with them to sign a consent form. Parent must have ID. (See Affidavit of Consent by Parent or Guardian form)
  • Each applicant who is 16 or 17 years of age must have an original or certified copy of their birth certificate
  • Both parties need forms of identification (See below for acceptable documents)
  • Both parties must read and sign a Premarital HIV/AIDS Education Pamphlet as required by Idaho law
  • Cost: $28.00. Payment types accepted are cash or credit card

Requirements for Parties under Age 16:

  • A court order is required if either party is under the age of 16. Must have an appointment with the Magistrate Judge to obtain this court order allowing the marriage
  • All other Requirements for Parties Ages 16 and 17 apply here

**Per Idaho Code Title 32-205 & 206, marriages between parents and children, ancestors and descendants of every degree, and between brothers and sisters of the half (1/2) as well as the whole blood, and between uncles and nieces, or aunts and nephews, and between first cousins are prohibited.**

Accepted Proof of Age Documents:

  • All parties over the age of 18 must have proper identification. This could be a Driver's License or State issued Identification Card or a Passport or any legal document with their name and birthdate on it.

Who Can Perform the Wedding Ceremony:

  • Judge
  • Mayor
  • Minister
